By accessing or purchasing from the Bearly Farms website, you agree to the following Terms of Service. Please read them carefully before using the site or placing an order.

1. Acceptance of Terms

By using this website or purchasing products from Bearly Farms, you agree to be bound by these Terms of Service, along with our Shipping Policy and Return & Refund Policy. If you do not agree to these terms, do not use this website or place an order.

2. Products & Live Plant Disclaimer

Bearly Farms sells live plants. As living products:

  • Plant size, appearance, and growth stage may vary

  • Minor cosmetic imperfections are normal

  • Growth, performance, and survival depend on planting, care, climate, and environmental conditions beyond our control

No guarantee is made regarding plant survival after delivery.

3. Orders & Payment

All prices are listed in U.S. dollars. Payment in full is required at the time of purchase.

Bearly Farms reserves the right to refuse, cancel, or limit any order due to availability, pricing errors, suspected fraud, or other reasonable circumstances. If an order is canceled after payment has been processed, a refund will be issued.

4. Shipping & Delivery

Shipping and delivery are governed by our Shipping Policy. Orders are shipped based on plant readiness, weather conditions, and seasonal timing.

Once a shipment is marked as delivered by the carrier, responsibility for the order transfers to the customer.

5. Returns & Refunds

Returns and refunds are governed by our Return & Refund Policy. All issues must be reported within 7 days of delivery.

If plants are shipped in error, Bearly Farms will correct the issue. If plants are received as ordered and returned for other reasons, return shipping costs and a 20% restocking fee apply.

6. Customer Responsibilities

Customers are responsible for:

  • Providing accurate shipping and contact information

  • Ensuring plants ordered are legal to receive in their location

  • Inspecting orders promptly upon delivery

  • Providing proper care after delivery

Failure to meet these responsibilities may result in denial of refunds or replacements.

7. Intellectual Property

All website content, including text, images, logos, and branding, is the property of Bearly Farms and may not be reproduced or used without written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Bearly Farms shall not be liable for indirect, incidental, or consequential damages related to the use of this website or its products.

Total liability shall not exceed the purchase price of the product giving rise to the claim.

9. Changes to Terms

Bearly Farms reserves the right to update or modify these Terms of Service at any time. Updates are effective immediately upon posting to the website. Continued use of the site constitutes acceptance of any revised terms.
